What Is Sexual Abuse?
Colorado law classifies sexual abuse based on the circumstances, with each offense involving different specifics and potential criminal consequences.
- Sexual assault: Sexual assault occurs when the defendant knowingly sexually penetrates a person against their will. This offense can constitute a class 2, 3, or 4 felony, depending on the number of people involved, the injuries to the victim, and the use of force, drugs, weapons, or threats to coerce or subdue the victim.
- Child sexual assault: Child sexual assault is the sexual assault of a victim under the age of 15 if the defendant is at least four years older. This offense can also include exposing the child to sexual or pornographic materials.
- Unlawful sexual contact: Unlawful sexual contact occurs when the defendant knowingly subjects another person to sexual contact without consent.
- Sexual harassment: Sexual harassment can include any sexual comments, threats, touching, or other acts that are unwelcome by the victim.

Victims in Colorado may seek justice in sexual abuse cases via both criminal charges and civil lawsuits, depending on the severity of the offense and how long ago the offense occurred.

What Compensation Is Available In A Colorado Sexual Abuse Case?
In a civil sexual abuse lawsuit in Colorado, victims can pursue a variety of damages depending on the circumstances of their case. For example, victims may be eligible to receive compensation for medical bills, therapy costs, lost wages, lost earning capacity, emotional distress, PTSD, pain and suffering, and more.
Courts may also award punitive damages in cases where the defendant’s conduct is malicious or wilful and wanton. Punitive damages aim to punish the perpetrator and deter future misconduct.
What Is Colorado’s Statute of Limitations on Sexual Abuse Cases?
In 2021, the Colorado legislature passed a law changing the state’s statute of limitations for sexual misconduct claims. Under that law, there is no civil statute of limitations for sexual misconduct claims occurring on or after January 1, 2022. Before this law, sexual abuse victims had just six years from the date of their abuse to pursue compensation in civil court.
For criminal sexual assault cases, Colorado has a 20-year statute of limitations for adult victims, and there is no statute of limitations if the victim was under the age of 15 at the time of the abuse. These deadlines only apply to abuse that occurred after January 1, 2016.
